Terms of Use

The terms for using Dulian Creator, the platform for creators and businesses, and the dulian.app website.

The provider of Dulian Creator is Dulian, owner Çağlar Körükcü, Wegmannstr. 1, 44795 Bochum, Germany (sole proprietorship), email: info@dulian.app. These terms apply to the use of the Dulian Creator application (Android app and web version) and the dulian.app website. Users' deviating terms do not apply unless we expressly agree to them.

Dulian Creator is intended for people aged 18 and over. By registering you confirm that you are at least 18 years old.

Dulian Creator is a platform for collaboration between creators and businesses. Creators can set up a profile, develop content for short-video platforms with AI assistance (for example hooks, captions, hashtags and platform tips), save results in a library, connect social media accounts to review metrics, and prepare collaborations with businesses and brands. Dulian makes introductions and provides the technical platform. Dulian is not a party to contracts that creators and businesses conclude with each other and does not owe any particular collaboration outcome, reach or income.

Individual features depend on platform and availability. Usage quotas apply to the AI features.

Dulian Creator is in a beta / closed test phase. Features, plans, quotas and interfaces may change, be restricted or be discontinued, and interruptions, errors or data loss may occur. We strive for reliable operation but do not promise any particular availability during this phase. Back up important content yourself, for example with the export function. Before we change features materially to your disadvantage, we will inform you where reasonable.

  • You must give correct information when registering and keep it up to date.
  • One account per person is intended. Your account is not transferable.
  • Keep your credentials secret and protect your device. You are responsible for actions under your account to the extent you are accountable for them. Tell us without delay if you suspect misuse.
  • You can delete your account in the app at any time (see Account deletion).

5. Your content

You keep the rights to the content you enter, upload or save in Dulian Creator (for example profile details, profile photo, inputs, saved results). You grant us a non-exclusive right, limited to the term of the contract, to store, process and display this content to you as needed to provide the platform, including transmission to the service providers named in the Privacy Policy.

You are responsible for your content. You warrant that you hold the necessary rights and that the content does not violate laws or third-party rights (for example copyright, trademark, personality or data protection rights).

Results of the AI features are generated automatically and may be incomplete, incorrect, unsuitable or similar to those of other users. Review every result before you publish or share it. You are responsible for ensuring that published content complies with the law, the rules of the respective platform and any labelling duties (for example for advertising). We give no warranty for the accuracy, suitability or freedom from third-party rights of results. You can report faulty or inappropriate results in the app.

Do not enter sensitive data or other people's personal data into AI inputs. See the Privacy Policy for more information.

You can connect Instagram, TikTok and YouTube accounts. Dulian is not affiliated with, endorsed by or sponsored by Meta, Instagram, TikTok, Google or YouTube. You are responsible for being entitled to use the connected accounts and for complying with the terms and policies of the respective platform. Whether the connection and the metrics are available depends on the platforms' interfaces; we cannot guarantee them, and platforms may restrict or end access. You can disconnect connected accounts at any time. Metrics are shown to you for your own analysis and are no guarantee of results.

Where features for working with businesses and brands are provided, the following also applies: contracts about collaborations, remuneration and services are concluded exclusively between creator and business. Both sides are themselves responsible for offers, commitments, invoices, taxes, advertising disclosure and respecting third-party rights. Your profile becomes visible to businesses only once we provide this feature and you have enabled it in the app.

You must not:

  • create or distribute unlawful, deceptive, discriminatory, harassing or youth-endangering content,
  • infringe third-party rights or impersonate others,
  • overload the platform through automation, bypass protective measures or quotas, or use interfaces without authorisation,
  • use the AI features to generate malware, spam or unlawful content,
  • share credentials or use third-party accounts without authorisation.

In case of violations we may remove content, restrict features, or suspend or terminate the account. We take your legitimate interests into account and, where reasonable, give notice beforehand.

Dulian Creator is free to use during the current test phase. Usage quotas per account apply to the AI features.

We are liable without limitation for intent and gross negligence, and for damage resulting from injury to life, body or health.

In cases of slight negligence we are liable only for breach of an essential contractual obligation, that is, an obligation whose fulfilment makes proper performance of the contract possible in the first place and on which you can regularly rely. In that case our liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability for slight negligence is excluded.

Mandatory statutory liability, for example under the Product Liability Act, and liability under a guarantee we have given remain unaffected. The provisions above also apply to the personal liability of our employees and agents.

The contract runs for an indefinite period. You can end it at any time by deleting your account. We may terminate the contract with 14 days' notice in text form; the right to terminate for good cause remains unaffected. After termination we delete your data in accordance with the Privacy Policy.

We may change these terms where there is an objective reason, for example new features, a change in the law or changes at service providers. We will inform you of changes in advance in the app or by email. For material changes we ask you to accept the new version before you continue to use Dulian Creator. If you do not agree, you can delete your account.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection rules of the country where you habitually reside remain unaffected. If a provision of these terms is invalid, the remaining provisions stay valid.
